THC-A Regulation Update
Yeaaahhh, so… all THC-A and smokable products are officially out of the store now. Here’s what went down:
SB 903 technically went into effect back in November 2024, but VDACS (the state agency that oversees hemp enforcement) decided to roll it out in phases:
Edibles enforcement — that’s when we all had to switch to the 25:1 CBD-to-THC ratio for infused products.
Smokables enforcement — and here’s the kicker: SB 903 redefined “marijuana” to include all forms of THC, not just Delta-9. That means THC-A is now considered marijuana under Virginia law.
VDACS originally planned to give us notice before starting smokables enforcement so shops like ours could sell through inventory and let customers know what was coming.
Unfortunately, that heads-up never came. Pressure from higher up pushed VDACS to start enforcing immediately, so we had to pull everything THC-A without warning — no time to prep, no time to give y’all notice, nothing.
Yeah, it sucks. It’ll hit our bottom line for a bit, but mostly I’m frustrated that you’re the ones left hanging. We know a lot of folks rely on these products, and we’re already working on it.
